Under Regulation 32(6), an offence is punishable on summary conviction by a class A fine or up to 6 months' imprisonment, or both; and on conviction on indictment by a fine of up to 60,000 euro or up to 18 months' imprisonment, or both. Regulation 34 provides a due diligence defence.

The National Disability Authority advises the authorities but has no enforcement role.
